⚖ The Constitutional Angle

Pastors admitted on religious visas had entered the United States, so under Kaoru Yamataya v. Fisher they are persons protected by the Fifth Amendment who cannot be removed without due process: at minimum notice and a meaningful opportunity to be heard, ordinarily before an immigration judge. Arrest over expired visas does not strip that floor away; release fit the process the Constitution requires.
