⚖ The Constitutional Angle
The pastors entered the United States on religious visas, so under Yamataya v. Fisher they are persons protected by the Fifth Amendment and cannot be removed without due process: at minimum, notice and a meaningful opportunity to be heard, today delivered through proceedings before an immigration judge. Their religious vocation and four-year overstay do not lower that floor.
