⚖ The Constitutional Angle

Rucho v. Common Cause held that federal courts may not decide partisan gerrymandering claims, finding no precise judicial standard. Louisiana v. Callais held a second majority-Black district an unconstitutional racial gerrymander and made Voting Rights Act dilution claims much harder to bring. Missouri's map turns on claim type: partisan challenges are barred in federal court, racial ones now face a much higher bar.

Partisan gerrymandering claims present nonjusticiable political questions: there is no 'limited and precise' judicially manageable standard for deciding how much partisan advantage is too much. The Court pointedly left open that state constitutions and statutes may supply standards enforceable in STATE courts, and that Congress retains power to regulate.

Per the supremecourt.gov slip-opinion listing (24-109_21o3.pdf) and CRS/SCOTUSblog analysis: the Court (6-3, Alito) held Louisiana's second majority-Black congressional district an unconstitutional racial gerrymander and reworked the Thornburg v. Gingles framework, making it materially harder to bring § 2 vote-dilution claims.
